Congressman Adam Smith Statement On The Microsoft Ruling

"I am pleased that the U.S. Court of Appeals for the District of Columbia has made the right decision by sending the Microsoft case back to a lower district court. Today's ruling represents a very positive development in what has been an overly long and burdensome trial. That this was a unanimous decision underscores the fact that the previous ruling was inappropriate given the facts of this case. 

I am also gratified with the decision to send the case to a different judge in the lower court. Throughout the earlier proceedings, I was troubled by Judge Thomas Penfield Jackson's apparent bias against Microsoft and was disappointed by some of his comments to reporters following his initial decision. It is my hope that the District Court will render a fair and appropriate decision.

This ruling is a very positive development for consumers and for the technology industry as a whole. Today's decision says to American companies that they are free to innovate and compete without the fear of unreasonable government intervention -- and it says to consumers that they will have robust, high-performance technology products available at reasonable prices. I am confident that the technology industry will continue to be an important driver of innovation and economic growth. 

Microsoft has made significant contributions to our nation's economy, to technological innovation and - most importantly - to the quality of life for American consumers. With this ruling it is my continued hope and expectation that Microsoft will remain the leader and innovator in tomorrow's market place."
