WASHINGTON – U.S. Congressman Bart Stupak (D-Menominee) applauded the U.S. Supreme Court’s decision today overturning the District of Columbia handgun ban. In the decision, the court declared for the first time ever that individuals have a constitutional right to own guns for self-defense.
“In the 232-year history of our country, today is the first time the right to bear arms has been affirmed as an individual right afforded to Americans for self-defense,” Stupak said. “This truly is a pivotal moment for gun ownership in the United States.”
The Supreme Court ruled 5-4 in the case of District of Columbia v. Heller. At issue was a 1976 law banning handgun ownership in the District of Columbia. The court ruled that while some regulations on gun ownership may be imposed by states, D.C.’s ban – the nation’s most restrictive gun law – goes too far.
“I am a strong supporter of our Second Amendment rights,” Stupak said. “The vast majority of gun owners are responsible sportsmen and women who like to hunt and shoot for sport. These activities are essential parts of our economy and our cultural heritage. I have consistently urged my colleagues to work for effective ways to curtail violent crime in America, but not by simply passing gun laws that unfairly penalize responsible gun owners.”
Stupak has long been a cosponsor of legislation to overturn the D.C. handgun ban. He also joined with a majority of the U.S. House and Senate earlier this year in signing an amicus brief to the Supreme Court in the case, urging the Supreme Court to overturn the D.C. handgun ban.
Stupak noted that the court’s ruling marks the first time the court has sought to define the meaning of the Second Amendment. The last time the court directly ruled on a Second Amendment case was 1939. |
