Representatives Schmidt, Engel and Terry Reintroduce
Drug Testing Integrity Act
Congresswoman Jean Schmidt, (R-OH) along with her colleagues Congressmen Eliot Engel, (D-NY-17), and Lee Terry (R-NE-02), have reintroduced the Drug Testing Integrity Act of 2011, H.R. 707.
H.R. 707 prohibits the manufacture, marketing, selling, shipping or otherwise providing an individual with any product designed for the purpose of assisting in subverting or masking a drug test.
“Drug testing is an important tool for public safety,” said Congresswoman Schmidt. “It doesn’t make sense for us to require drug tests while allowing products to be marketed and sold to subvert the results of these tests,” Schmidt said.
Under H.R. 707, the United States Federal Trade Commission (FTC) would be tasked with implementing and enforcing the ban on subversion products. Anyone found violating the law would be subject to stiff civil penalties and fines. The legislation would impose penalties not only for using masking agents but also for manufacturing, marketing, and selling such products.
“These products normalize behavior that ruins lives. As I said when we first introduced this bill last year, it is ridiculous that you can walk into a store and buy a product that undermines a drug test,” Schmidt concluded.
