What
reemployment rights do I have after my mobilization? |

The Uniformed
Servicemembers Employment and Reemployment Rights Act (USERRA) is a Federal law that provides reemployment rights for veterans and
members of the National Guard and Reserve following qualifying military
service. It also prohibits employer discrimination against any person on the
basis of that person’s past military service, current military obligations or intent
to join one of the uniformed services.

Labor (DOL), through the Veterans'
Employment and Training Service (VETS) enforces USERRA and provides
assistance to all persons having claims under this law. For

What
is the Servicemembers Civil Relief Act (SCRA), and what protections does it
provide? |
 |
The SCRA is a federal law that provides important legal
protections to active duty military members and members of the Reserve
or National Guard called to active duty, covering such issues as as
rental agreements, security deposits, prepaid rent, eviction,
installment contracts, credit card interest rates, mortgage interest
rates, mortgage foreclosure, civil judicial proceedings, and income tax
payments.

Am I eligible for military retired pay
and VA disability compensation? |
 |
Prior to 2004, military
retirees were required to waive their military retired pay in order to
received VA disability compensation. In 2004, the law was changed
to phase-in the concurrent receipt of both VA disability and retired pay
for qualified military retirees through 2014.
To qualify for Concurrent
Retirement and Disability Pay (CRDP), a military retiree must have 20 or
more years of service and a VA disability rating of 50% or
higher.
Combat-Related Special Compensation
(CRSC) pays added benefits to military retirees who receive VA disability compensation for combat-related disabilities.

Chapter 61 Retirees:
The 2008 National Defense Authorization Act (NDAA) expanded eligibility to medical retirees with less than 20 years of service, effective January 1, 2008.

How do I locate

 |
Each of branch of the U.S.
Armed Forces has separate procedure for contacting active or past
service members. In cases of emergency, immediate family members should
contact the local chapter of the American
Red Cross for assistance.
