These updated deed restrictions will be referenced in the managers amendment and apply to the Stanley land exchanges.

Federal Lands in the Sawtooth National Recreation Area Considered for Transfer to Custer County or the City of Stanley
By an Act of Congress

Parcel A – approximately 8 acres adjoining the western boundary of the City of Stanley (T10N, R13E, Sec 9, NW¼, NE¼ -- Map reference: PX36). An attached aerial photograph (Exhibit A) shows the location of Parcel A.

Ownership of Parcel A to be transferred to the City of Stanley.

Permitted uses:

Up to four (4) home sites may be developed on Parcel A.

One (1) single-family house may be built on each home site.

Use --  Residential.

Size – No more than 3,000 square feet gross floor space, including attached garage, but excluding basements, decks and porches; single story no more than 22 feet in height from natural ground level, excluding chimney(s).

Design  -- Western ranch-style having rectangular or square sections with no more than two ridgelines, excluding dormers.

Windows – Rectangular or square, divided light and no more than 24 square feet in size. Windows on exterior walls visible from Highway 21 must encompass less than 30% of the area of the wall.

Structure siding – log, log-sided, rough-sawn lumber, or board and batten, or suitable wood substitutes; harmoniously colored or natural wood finish.

Roof – Wood, composite or non-reflective metal in muted earth tones of brown.

One (1) outbuilding may be built on each home site.

Use – No kitchen, sleeping facilities, or otherwise equipped for residential purposes.

Size – No more than 600 square feet gross floor space; single story no more than 22 feet from natural ground level.

Design – Western ranch-style having rectangular or square sections with no more than one ridgeline.

Windows – rectangular or square, divided light of no more than 24 square feet.

Structure siding – Log, log-sided, rough-sawn lumber, or board and batten, or suitable wood substitutes; harmoniously colored or natural wood finish.

Roof – Wood, composite or non-reflective metal in muted earth tones of brown.

Satellite Dish – One (1), up to 24 inches in diameter and located as unobtrusively as best available technology allows.

Exterior lights – Two (2) nighttime exterior lighting sources shielded downwards and not to exceed 150 watts each; none flashing.

Landscaping – Compatible with the open setting and incorporating materials and groundcover, shrubs and trees that are indigenous to the area; areas exposed due to excavation must be rehabilitated to pre-excavation conditions within two years following the completion of construction.

Roads and driveways – Not to exceed 14 feet in width.

Fences – Log worm, log block or jack style; must incorporate wildlife-friendly elements.

Utilities – All new utilities will be underground.

All improvements to Parcel A must be approved in writing, and in advance of being made, by the City of Stanley. The City of Stanley may enter any of the properties authorized above at reasonable times to monitor compliance with these deed restrictions.

Parcel B – approximately 86 acres, including a road encompassing approximately 15 acres, adjoining the northern boundary of the City of Stanley. (Parcel B is located within a larger federal parcel described as T10N, R13E, Sec 3: Lots 4,5,6 SW¼, Lot 9, NW ¼ NW 1/4; Sec 4: Lots 1,2,3,4 SE 1/4 NW 1/4, S 1/2 NE 1/4, N 1/2,SE 1/4). The legal description for Parcel B will be prepared as soon as practical. The road through Parcel B will be accessible to the public for access to adjacent federal land. An attached aerial photograph (Exhibit A) shows the location of Parcel B.

Ownership of Parcel B to be transferred to Custer County.

Permitted uses:

Up to ten (10) home sites may be developed on Parcel B. Houses and outbuildings may not be visible from Highways 75 and 21.

One (1) single-family house may be built on each home site.

Use – Residential.

Size – No more than 3,500 square gross floor space, including attached garage, but excluding basements, decks and porches; no more than 26 feet in height from natural ground level, excluding chimney(s).

Design – Western ranch-style having rectangular or square sections with no more than three ridgelines, excluding dormers.

Windows – Rectangular or square, divided light and no more than 24 square feet in size. Windows with exterior walls visible from Highways 21 or 75 must not exceed 30% of the area of the wall.

Structure siding – log, log-sided, rough-sawn lumber, or board and batten, or suitable wood substitutes; harmoniously colored or natural wood finish.

Roof – Wood, composite or non-reflective metal in muted earth tones of brown.

Two (2) outbuildings may be built on each home site

Use – No kitchen, sleeping facilities, or otherwise equipped for residential purposes.

Size – No more than 850 square feet gross floor space in the aggregate; single story no more than 26 feet from natural ground level.

Design – Western ranch-style comprised of rectangular or square sections with no more than one ridgeline.

Windows – rectangular or square, divided light of no more than 24 square feet.

Structure siding – Log, log-sided, rough-sawn lumber, or board and batten, or suitable wood substitutes; harmoniously colored or natural wood finish.

Roof – Wood, composite or non-reflective metal in muted earth tones of brown.

Satellite Dish – One (1), up to 24 inches in diameter and located as unobtrusively as best available technology allows.

All improvements to Parcel B must be approved in writing, and in advance of being made, by Custer County. Custer County may enter any of the properties authorized above at reasonable times to monitor compliance with these deed restrictions. 

Note: Parcel B is located on a federal grazing allotment held by Mark Stark, Mitch Wilson and Steve Helm, of Challis.

Parcel C – approximately 68 acres (including improvements) adjoining the northeastern boundary of the City of Stanley (Parcel C is located within a larger federal parcel described as T10N, R13E, Sec 3: Lots 4,5,6 SW ¼, Lot 9, NW ¼ NW 1/4; Sec 4: Lots 1,2,3,4 SE ¼ NW ¼, S ½ NE ¼, N ½ SE ¼.)  The legal description for Parcel C will be prepared as soon as practical. An attached aerial photograph (Exhibit A) shows the location of Parcel C.

Ownership of Parcel C to be transferred to the City of Stanley.

This parcel will not be developed further until such time that a development plan consistent with the uses described herein is reviewed and approved by a special commission. Commission members will include one elected official representing Custer County, one elected official representing the City of Stanley and three citizens-at-large, who reside within the boundaries of the Sawtooth National Recreation Area (SNRA). The citizen representatives will be selected jointly by the elected government representatives.

Permitted uses:

Housing for people employed full-time – year around  or seasonally-- within the boundaries of the SNRA, and their immediate family members.

Other public purposes such as, but not limited to, a park, cemetery, community center or educational facility.

Design – Western ranch-style with rectangular or square sections with no more than three ridgelines, excluding dormers.

Size – Compatible with the building site and type of use.

Height -- Not to exceed 30 feet from natural ground level.

Windows – Rectangular or square, divided light and no more than 25 square feet. Windows on exterior walls visible from Highways 75 and 21 must encompass less than 30% of the area of the wall.

Structure siding – Log, log-sided, rough-sawn lumber or board and batten, or suitable wood substitutes; harmoniously colored or natural wood finish; native stone accents.

Roof – Wood, composite or non-reflective metal roofing material in earth tones of brown.

Satellite dish – One per structure up to 24 inches in diameter and located as unobtrusively as best available technology allows.

Exterior lights – downward shielded; none flashing

Landscaping – Compatible with open setting and incorporating materials and groundcover, shrubs and trees that are indigenous to the area; areas exposed to excavation must be rehabilitated to pre-excavation conditions within two years following the completion of construction.

Roads and driveways – Not to exceed 24 feet in width.

Fences – Log work, log block or jack style; must incorporate wildlife friendly elements.

Utilities – All new utilities will be underground

Signs – Only signs identifying a commercial enterprise being conducted on the property.

Signs will not to exceed 20 square feet in area, and must be subdued in appearance and harmonizing in design and color with the surroundings; none flashing.

All improvements to Parcel C must be approved in writing, and in advance of being made, by the City of Stanley. The City of Stanley may enter the property at reasonable times to monitor compliance with these deed restrictions.

Prohibited uses on Parcels A, B and C:

Except as expressly authorized in “Permitted Uses” above, Parcels A, B and C may not be divided, subdivided or defacto subdivided through sales, long-term leases or otherwise.

Commercial, manufacturing, industrial, mining or drilling operations. Exception: small in-home businesses such as professional services may be allowed on Parcels A, B and C, and certain commercial operations may be allowed on Parcel C, subject to the approval of the City of Stanley.

Exploration, development or extraction of minerals.

Dumping or accumulation of trash, debris, junk cars, unserviceable equipment or other unsightly materials.

Placement of residential trailers, mobile homes, manufactured homes, modular buildings or other such semi-permanent structures.

Placement of towers, antennae or satellite dishes that are not concealed from public view, except to the extent that the right is expressly granted in “Permitted Uses” above.

Placement of signs, billboards or other advertising devices other than: one (1) property identification sign and one (1) for sale or rental sign not to exceed two square feet in area; such signs must be harmonious in design and color with the surroundings.

Disposal or unlawful storage of hazardous substances, as defined by the Comprehensive Environmental Response, Compensation Liability Act (CERCLA), 42 USC. 9601 et. Seq.

Enforcement:

Custer County is responsible for enforcing the terms of the deed restrictions contained herein for Parcel B. The City of Stanley is responsible for enforcing the terms of the deed restrictions contained herein for Parcels A and C.
