June 26, 2008
Rep. Waxman
Introduces H.R. 6381, the Medical Device Safety Act of 2008
On
Thursday, June 26, 2008, Chairman Frank Pallone, Jr. and Chairman Henry
A. Waxman introduced H.R. 6381, The Medical Device Safety Act of
2008. The legislation will reverse a recent U.S. Supreme Court
decision which immunized medical device companies from state lawsuits
brought by patients who are injured by certain FDA-approved medical
devices. Without this legislation, patients will be unable to seek
compensation for their injuries, medical expenses and lost wages
resulting from injuries caused by defective premarket approval (PMA)
devices or inadequate safety warnings.
